Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering on, or using BestInThe.com (the “Platform”), you agree to be bound by these Terms of Service and all applicable laws and regulations. These Terms form a binding agreement between you and BestInThe.com. If you do not agree to these Terms, please do not use the Platform. By creating an account, you affirmatively accept these Terms.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

You must provide accurate, current, and complete information when you register and keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You may close your account at any time by contacting support, subject to any obligations you have already incurred.

4. Domain Listings and Transactions

Sellers may list domain names for sale, set pricing, and receive offers. Buyers may make offers, accept fixed-price listings, or purchase domains through checkout links. By listing a domain, the seller represents that they own or control the domain, have full authority to sell and transfer it, and that the listing and its metadata are accurate.

Making an offer, accepting an offer, or completing a purchase through a checkout link creates a binding agreement between the buyer and the seller, subject to these Terms. Prices and fees are displayed in US Dollars (USD). A listed domain remains available until the first confirmed payment for it is received. If multiple buyers complete payment for the same domain, the first confirmed payment takes precedence, and any duplicate payments will be refunded.

5. Payment Methods and Fees

The Platform supports payment through PayPal and, for eligible transactions, our escrow partner Escrow.com. The minimum transaction amount is $100, and PayPal payments are limited to $1,500 per transaction.

Buyers pay the agreed domain price plus the payment fee for their chosen method: a 4.5% PayPal processing fee on PayPal payments, or the separate escrow fee charged by our escrow partner on escrow payments.

Sellers pay a platform commission on completed sales: 9% for standard sales, 5% for sales of domains pointing to our nameservers (lander sales), and 3% for checkout link sales. A minimum platform commission of $15 applies to PayPal payments and $50 to escrow payments, in addition to the commission rate. The commission is deducted from the seller’s sale proceeds.

All applicable fees are disclosed before you complete a transaction. Fees may be updated from time to time; the fees applicable to a transaction are those disclosed at the time of the transaction. You are responsible for any taxes associated with your use of the Platform.

6. Escrow Services

Escrow services are provided by our third-party partner Escrow.com under its own terms and conditions. When an escrow transaction is initiated, funds are held by the escrow provider and are released to the seller after the domain has been transferred and the buyer confirms receipt (or the applicable confirmation period lapses without a dispute).

Users agree to comply with the terms of the escrow provider. We may require additional verification and may review transactions for compliance or to prevent fraud. If a transaction cannot be completed, funds are returned in accordance with the escrow provider’s terms.

7. Transfer and Delivery

After a payment is confirmed, the seller must initiate and cooperate with the transfer of the domain promptly, including unlocking the domain and providing any required authorization code. The buyer must cooperate to receive the transfer and confirm receipt once the domain is delivered.

If a transfer does not complete, funds will be returned in accordance with the applicable payment or escrow terms, or the transaction will be resolved through support. Buyers and sellers agree to act in good faith to complete transfers promptly.

8. Refunds and Cancellation

All sales are final once a payment completes. Refunds are available only (a) where a transfer or escrow fails to complete and the funds are returned, (b) for duplicate payments, or (c) as otherwise required by applicable law.

Before payment, a buyer or seller may cancel an accepted transaction through the Platform in accordance with its then-current functionality. Accepted transactions that remain unpaid may be subject to payment reminders and, ultimately, cancellation.

9. Prohibited Conduct

You may not use the Platform for unlawful, fraudulent, or abusive purposes. Prohibited conduct includes, but is not limited to:

• Listing, selling, or transferring domains you do not own or control, or domains that infringe trademarks or other third-party rights.
• Engaging in fraud, misrepresentation, chargeback abuse, or circumventing Platform fees.
• Manipulating offers, prices, or bidding to deceive other users.
• Scraping, harvesting, or interfering with the Platform, its services, or other users’ data.
• Impersonating others, distributing malware, or otherwise acting to harm the Platform or its users.

10. Intellectual Property

All content on the Platform, excluding user-provided content, is owned by BestInThe.com and protected by intellectual property laws. You may not copy, modify, or distribute Platform content without permission. By listing a domain, you grant us a limited license to display your listing on the Platform and related communications for the purpose of facilitating its sale.

11. No Warranties

The Platform and all services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any domain will be sold, that any transfer will complete without delay, or that the Platform will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, BestInThe.com is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the Platform. Our total liability to you shall not exceed the fees paid by you to the Platform in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless BestInThe.com and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your listings, or your breach of these Terms.

14. Termination

We may suspend or terminate your account or access to the Platform at any time for violations of these Terms or for any other reason, with notice where practical. You may also close your account at any time by contacting support. Provisions that by their nature should survive termination, including those relating to fees, intellectual property, limitation of liability, and indemnification, will survive.

15. Disputes and Governing Law

We encourage you to contact support to resolve any issue or dispute before taking formal action. Both parties agree to first attempt to resolve disputes informally by contacting support@bestinthe.com. If a dispute is not resolved informally, it will be resolved in the courts of the applicable jurisdiction.

These Terms and any dispute arising out of or relating to the Platform are governed by the laws of the jurisdiction in which the Platform operates, without regard to its conflict-of-law principles.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date at the top of this page and, where appropriate, by notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

17. Entire Agreement; Severability; Waiver

These Terms constitute the entire agreement between you and BestInThe.com regarding the Platform. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of that provision.
